Payment & Facility Terms

"Item"

Any bucket package (Small, Large, Jumbo), Divots Driving Range Pass, punch card, gift card, or other product purchased online or at the facility.

"Kiosk"

The on-site ball dispenser and payment terminal, which may accept QR code scans, credit/debit cards, Apple Pay, or Google Pay.

"Platform"

Any third-party service (such as Sweetspot) used to process or facilitate your online purchase.

1. 1.All Pass purchases must be made using a valid credit card, debit card, or approved digital wallet (Apple Pay/Google Pay). Divots Driving Range ball dispensing system is credit-card-only; cash is not accepted at the Kiosk.
2. 2.Prices for buckets and passes are listed on DivotsErie.com and at the facility and are subject to change without notice. The price in effect at the time of your completed purchase applies to that transaction.
3. 3.You are responsible for ensuring your payment information is accurate and for any fees your bank or payment provider charges in connection with the transaction (e.g., currency conversion or processing fees).
4. 4.A purchase confirmation or electronic receipt will be provided by email or displayed in the Platform. Retain this confirmation, as it may be required to resolve any issue with your Pass.
5. 5.If we use a third-party platform (such as Sweetspot) to process your payment, that platform acts solely as a technical payment and booking service. Your purchase contract is with Divots Driving Range, not the platform provider, and all questions about your Pass, refunds, or facility use should be directed to Divots Driving Range.

1. 1.Bucket Passes (Small/Large/Jumbo): Redeemable for the stated number of range balls at the Kiosk. Bucket passes must be used within the time frame indicated at the time of purchase unless otherwise stated at checkout.
2. 2.Divots Range Passes: A range pass purchase granting the benefits described on DivotsErie.com at the time of purchase. Pass benefits, pricing, and availability may be modified or discontinued for future purchasers at our discretion; benefits already granted to existing Pass holders will be honored for the stated term of the membership.
3. 3.Passes are valid only for the season and hours of operation posted on DivotsErie.com. Divots is a seasonal outdoor facility and does not guarantee availability during winter months, inclement weather, or scheduled maintenance.
4. 4.Lost, stolen, or expired Passes are not eligible for replacement or extension except at Divots' sole discretion.

1. 1.Passes are non-transferable and may not be sold, gifted, or shared with another individual unless expressly marked as a shareable/family pass at the time of purchase.
2. 2.Each bucket redeemed at the Kiosk is intended for use by the purchaser or the individual present at the bay. Divots Driving Range reserves the right to limit one active bucket redemption per bay at a time.
3. 3.Passes are issued to a single named individual and may not be used by another person.

1. 1.All Pass purchases are final and non-refundable once completed, except as required by applicable law or as expressly stated in these Terms.
2. 2.If Divots Driving Range cancels or is unable to provide access to the range for reasons within our control (e.g., extended facility closure), we will offer an equivalent credit toward future use or, at our discretion, a refund for unused balance.
3. 3.Divots Driving Range is not responsible for your inability to use a Pass due to weather, personal scheduling conflicts, or failure to use the Pass within its validity period.
4. 4.Chargebacks or payment disputes filed without first contacting Divots Driving Range to resolve the issue may result in suspension of your Pass or account.

1. 1.Passes are for personal, recreational use of the driving range bays, targets, and related practice areas at Divots Driving Range. Commercial use (e.g., paid lessons by non-Divots Driving Range instructors, resale of bucket access) is prohibited without prior written consent from Divots Driving Range.
2. 2.Customers must follow all posted range rules, staff instructions, and safety guidelines, including rules governing bay assignment, appropriate footwear/attire, and use of personal versus range-issued golf balls.
3. 3.Divots Driving Range reserves the right to refuse service, revoke a Pass without refund, or remove any individual from the property for unsafe conduct, abusive behavior, damage to property, or violation of these Terms.
4. 4.Children must be accompanied and supervised by a parent or guardian at all times while on the property.

1. 1.Golf is a sport with inherent risks, including but not limited to being struck by golf balls or clubs. By using a Pass, you acknowledge and assume these risks for yourself and any minors in your care.
2. 2.To the fullest extent permitted by law, Divots Driving Range, its owners, employees, and agents are not liable for personal injury, property damage, or loss arising from use of the facility, except to the extent caused by our gross negligence or willful misconduct.
3. 3.Use of the Kiosk, dispensing equipment, and other technology is at your own risk. Report any equipment malfunction to staff immediately rather than attempting repairs yourself.

1. 1.Divots Driving Range is an outdoor facility. Range hours and bay availability may be shortened or suspended due to weather, lightning, darkness, maintenance, or events, without liability to Divots Driving Range.
2. 2.Unused buckets or time on a Pass are not automatically extended due to weather closures unless Divots Driving Range states otherwise for a specific closure.

1. 1.Information collected during your online purchase (name, email, payment details) is used to process your transaction, provide receipts, and, if you opt in, send communications about Divots Driving Range events and promotions.
2. 2.Payment card information is processed by our payment processor/Platform and is not stored directly by Divots Driving Range.

Divots Driving Range may update these Terms and Conditions at any time. The version posted on DivotsErie.com at the time of your purchase governs that transaction. Continued use of a Pass after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of Divots Driving Range shall be resolved in the state or federal courts located in Erie County, Pennsylvania.
